Basics of Hungarian and EU regulation
The most important domestic and EU legal frameworks that affect network sales and communication with consumers - explained clearly, for leaders.

Many network builders think that regulation is the company's business, not theirs. This is a dangerous misconception. Your communication, your posts, your presentations and your promises fall directly under the scope of the law - and the responsibility often rests on you personally too. This lesson gives an overview of the most important Hungarian and EU regulatory frameworks. It is not legal advice but an orientation map, so that you know where the boundaries are and whom to turn to.
The EU foundation: the prohibition of unfair commercial practices

The backbone of European regulation is the directive on unfair commercial practices (Directive 2005/29/EC), which every member state has incorporated into its own law. It has a so-called blacklist - practices that are prohibited under all circumstances. On this list, the creation, operation and promotion of a pyramid scheme is named specifically, where the consumer pays a joining fee and their reward comes primarily from the enrollment of further consumers, not from the sale of products.
This matters because EU law lays down the pyramid definition itself, thereby providing a uniform standard. The directive also prohibits misleading and aggressive commercial practices - this includes excessive pressure, the creation of false scarcity and unfounded claims.
The Hungarian legal framework
In Hungary, several pieces of legislation are relevant. Together they form the environment in which you must operate honestly. It is worth at least being aware of their existence, so that you know what expectations you have to meet.
- Act XLVII of 2008 on the prohibition of unfair commercial practices against consumers (the domestic transposition of the EU directive).
- Act XLVIII of 2008 on the basic conditions of commercial advertising activity, which applies to advertising and misleading claims.
- Act CLV of 1997 on consumer protection, which regulates consumer rights and complaint handling.
- The contractual and liability rules of the Civil Code (Act V of 2013), which also affect the relationship between the member and the company, as well as between the member and the buyer.
- The Criminal Code, which also names the organization of a pyramid scheme as a distinct criminal offence.
Who supervises, and what does this mean in practice?
In Hungary, several authorities supervise this area: the consumer protection authority oversees unfair practices and consumer complaints, while the Hungarian Competition Authority (GVH) may investigate the deception of consumers and unfair market conduct. In the area of data protection, the supervision of the GDPR and the NAIH concerns how you handle prospects' data - this surprises many, even though a simple contact list is already personal data.
The practical conclusion is simple: the rules are not abstract legal subtleties but directly determine what you may write in a post, what you may say at a presentation, and how you may handle people's data. Ignorance is no excuse. That is why every serious network builder should be familiar with this framework at least at a basic level, and always turn to an expert in a specific case - this lesson is only an orientation point, not legal advice.
Regulation is not a constraint but the competitive advantage of the honest player - because it filters out those who do not play this way.
