Pyramid scheme vs. legitimate MLM - the legal line
Where exactly the line runs between lawful network sales and a prohibited pyramid scheme, and how to recognize the warning signs in time.

This is perhaps the most important lesson in the entire module. The biggest reputational problem of the network marketing industry is that many people confuse legitimate network sales with a prohibited pyramid scheme. The difference between the two is not a matter of nuance - legally it is sharp, and standing on the wrong side is not only unethical but can also be a crime. As a leader, it is your responsibility to recognize the line and to build an organization that is safely on the right side.
The decisive question: where does the money come from?

The most reliable test is a single question: does the revenue come primarily from selling real products and services to end consumers, or primarily from enrolling new members? If the bulk of the money comes from product turnover, and there is genuine consumer demand for the product, then we are talking about a legitimate model. If the bulk of the money comes from enrolling new people who pay a joining fee or a mandatory starter package, then it is a pyramid scheme - regardless of whether there is a product at all.
Pyramid schemes often disguise themselves with a product. The trick is that the product exists, but nobody buys it because they need it - rather because it is mandatory for the commission or the rank. This is the product alibi. If the product were to disappear, and the model still worked on the enrollments, then you are dealing with a pyramid scheme.
The warning signs
There are telltale signs that immediately indicate risk. It is worth knowing these by heart, because the protection of your own organization also depends on them.
- The main source of income is the enrollment of new members, not the sale of products to end consumers.
- A high, mandatory joining fee or an expensive compulsory starter package to join.
- A mandatory regular order (autoship) justified not by real consumption but by keeping the rank.
- There is no genuine end-consumer demand - the product sits almost exclusively in the members' hands, as stock.
- There is no, or only a limited, buyback / refund guarantee on accumulated stock.
- The emphasis is almost exclusively on recruitment, while the use and value of the product recede into the background.
- Unrealistic income promises and pressure to join quickly.
Inventory loading and the end-consumer test
Two concepts every leader must know. Inventory loading is when members are encouraged to buy more product than they can realistically sell or use, for the sake of rank or commission. Accumulated, unsellable stock is a classic symptom of a pyramid scheme. Legitimate companies actively prohibit this and provide a buyback guarantee.
The end-consumer test (retail/customer test) examines whether the products have a genuine market outside the network. In a healthy model, there is a significant proportion of buyers who are only consumers, not business builders - they prove that the product has value in its own right. If every buyer is also a member, that is suspicious.

If the product were discontinued tomorrow, and the money still flowed in the same way from the enrollments - then it was never about the product.
